The general terms and conditions of MJD's online store are drawn up in accordance with the Consumer Protection Act (ZVPot), the Personal Data Protection Act (ZVOP-1) and the Electronic Communications Act (ZEKom-1).

4. Online ordering and online ordering terms

• By placing an order in the shop.mjd.si online store, you agree to these terms of business, which form an integral part of the contractual relationship between the client and MJD, (Matic Jelovčan Design s.p., Šutna 67, 4209 Žabnica, Slovenia) arising from the supply of goods to the customer by MJD and at the same time to receive and pay for the goods by the customer.

• By placing an order in the MJD.si online store, you fully agree to and accept these terms.

4.1 Purchase agreement

The purchase contract is concluded when the customer actually picks up and pays for the ordered goods. The purchase contract is concluded in the Slovenian language and is stored with the company. You can receive it upon written request. The contract can only be concluded in the Slovenian language

4.2 Prices

• All prices are in EUR and do not include VAT (seller is not taxable).

• Prices published are subject to change without notice. Individual purchases are subject to prices when the order is placed.

• We reserve the right to make changes and mistakes in prices and written text. We apologize in advance for any errors.

• As a rule, discounts and other campaigns do not add up.

• Delivery cost is indicated in the shopping cart before order confirmation.

4.3. Validity of tenders

Deals on shop.mjd.si are limited in time and quantity. Quantities of products in stock and estimated delivery times, published on each offer and products, are informative and subject to change without notice.

4.4 Validity of the contract

The order is finally confirmed and completed when we send you an e-mail confirmation of the order after your online order has been placed, to your e-mail address, which you will specify when executing the order. Up to 15 minutes after the order has been placed, you can notify by email or telephone of the change of order or withdrawal of the order.

4.5 Delivery and Acceptance of Goods

• We do our best to prepare and ship all the ordered shipments quickly, usually within ten working days, depending on the stock available. Some products are custom made; shipment time may also depend on the quantity of the order and the time of production of each product. The goods ordered will be delivered within the time limit specified in each individual offer.

• MJD reserves the right to notify the customer within a period from the confirmation of receipt of the order to the delivery of the goods, in case the desired goods are unavailable, or during that time there were unforeseen problems related to delivery, and such order in it shall also cancel the last resort.

• The goods will be delivered with an invoice that serves as both a tax and a guarantee document. The bill specifies all costs associated with the purchase and the price. The buyer is obliged to check the correctness of the information before placing the order. Later objections to the invoices issued are not taken into account.

• The cost of the package is EUR 1.90, and the delivery price depends on the postal service provider and the weight of the product.

• For orders over 2500 EUR, delivery is free.

• The delivery service reserves the right to properly verify the identity of the consignee (access to personal or other documents).

4.6 Payment methods

4.8 Cancellation and Return of Products

In the case of distance or off-premises contracts, the consumer has the right, within 14 days of taking over the items, to inform the company that he is withdrawing without having to give a reason for his decision. A consumer shall be deemed to have submitted his / her resignation statement in a timely manner if he / she sends it within the time limit set for withdrawal from the contract (Paragraph 2 (b43.d) of ZVPot). The full cost of shipping and / or returning the goods in the event of a return shall be borne by the buyer, in the event of cancellation of the contract, the company shall, immediately or within 14 days of receipt of the notice of withdrawal, return all payments received.

The company returns the payment received to the customer on his Transaction account or Paypal account, but only if the payment was made to the customer using a Paypal account.

In the case of sales contracts, the company may withhold the repayment of the payments received until the goods have been returned or until the consumer has provided proof that he has sent the goods back, unless the company offers the option of only accepting the returned goods.

If the consumer has already received the goods and withdraws from the contract, it shall be returned or delivered to the company or the person authorized by the company to take over the goods, immediately or within 14 days after the notification referred to in the first paragraph of Article 43č of this Act, unless the company offers, to only take back the goods returned. A consumer shall be deemed to return the goods in good time if he or she sends them before the expiry of the 14-day return period.

Consumers are only charged for the cost of returning the goods in connection with the cancellation of the contract, unless these costs are borne by the undertaking by prior arrangement or if the undertaking does not inform the consumer in advance that he is charged for that cost. MJD does not accept ransom items.

The consumer does not have the right to withdraw from the contract in the case of contracts, the object of which is an article made according to the exact instructions of the consumer, which was adapted to his personal needs, which by its nature is not suitable for return.

The consumer is responsible for reducing the value of the goods if the decrease in value is the result of conduct which is not strictly necessary to determine the nature, characteristics and functioning of the goods. The consumer shall not be liable for the reduction of the value of the goods if the company does not inform him of the right to withdraw from the contract in accordance with point 4 of the first paragraph of Article 43b.

4.9 Material damages

The buyer may request an immediate replacement for the same, faultless product, or within the statutory time limit and under the conditions for claiming a material error.

The error is real:

• if the item does not have the characteristics necessary for its normal use or for traffic;

• if the item does not have the characteristics necessary for the specific use for which the buyer is buying it, which was known or should be known to the seller;

• if the thing does not have the characteristics and qualities that were explicitly or tacitly agreed upon or prescribed;

• if the seller has delivered a thing that does not match the pattern or model, unless the pattern or model was shown for notice only.

The suitability of goods for normal use shall be judged in the light of ordinary goods of the same type and in the light of any seller's statements concerning the characteristics of the goods made by the seller or manufacturer, in particular by advertising, presenting the product or quoting the goods themselves.

The consumer may exercise his rights as a result of a material defect by notifying the seller within two months of the date when the defect was discovered. The consumer must give a more detailed description of the error in the error message and allow the seller to inspect the matter. An error message can be communicated to the seller personally by the consumer, and the seller must issue a certificate, send it to the store where the item was purchased, or to the seller's agent with whom it has contracted.

In any case, the consumer has the right to demand from the seller compensation for the damage, and in particular for reimbursement of the costs of materials, spare parts, labor, transfer and transportation of the products incurred in order to fulfill the obligations referred to in the previous paragraph of this Article.

4.10 Order progress with payment obligation

The order is as follows:

1. On the shop.mjd.si website, there is an icon in the upper right corner of the shopping cart icon in which the user (after clicking on the icon) shows the products that he added to the shopping cart while browsing the online store.

2. The user adds products to the shopping cart by clicking on the "Add to Cart" button. Before that, it must conditionally select an additional parameter (say size, color, etc.).

3. The user can then proceed with the product inspection and add additional products to the shopping cart.

4. The user initiates the purchase process by clicking on the shopping cart link and then on the "Cashier" button.

5. The user is presented with a basket of products in the basket, where he can remove the products, change their quantity (by + or -), size, color or add products.

6. User Fill in the contact information (name, surname, GSM, e-mail, address, postal code).

7. In case the user wants delivery to another address - fill in the field "I want delivery to another address" where he enters (name, surname, address, postal code).

8. User Selects the payment method.

9. User Enter the discount code (if any) and press the "Apply" button.

10. In the last step, the user re-examines the details of the order, enters a possible comment on the order, agrees to the general terms and ends it by clicking on the "Payment order" button. In the case of missing data, the user is shown in the error field a "required field" in red.

11. When the user clicks on the "Payment order" button, the system accepts the order, and automatically sends an email to the user - acknowledgment of acceptance of the order, an email address sent to the user.

The user can also order the desired products by telephone or e-mail.

4.12. Technological means enabling the identification and correction of errors prior to the finalization of the order

Prior to completing the order, the user (buyer), through a graphical user interface, is able to, with immediate effect, easily and easily:

• see and review what products he has selected and add to his shopping cart,

• see and review the price of each product and the total price of the total selected quantity of each product,

• changes the selected quantity of each product and calculates the new price of the quantity so changed,

• removes selected items that it does not want to buy from the shopping cart; and

• calculates the associated tax according to the tax rate applicable to the selected product and its price (tax base).

Prior to confirming the order, the user (buyer) is enabled, through a graphical user interface, with immediate effect, easily and easily:

MJD reserves the right to delete from its wall on Facebook Page records that contain blatant untruths, are inappropriate, misleading or offensive. MJD is not responsible for the information in the opinions and is limited from any liability arising from the information provided in the opinions.

MJD reserves the right to disable or disable access to the Website due to technical or other problems and maintenance, which also means disabling or impeding the use of the Online Store. MJD is not responsible for any damages or costs incurred by the customer as a result of termination, inactivity or obstruction of the website.
